Louisville man wanted on murder charges arrested in Texas

LOUISVILLE, KY (WAVE) ? A man wanted in Louisville on charges of murder, arson, tampering with physical evidence and abuse of a corpse was arrested in Dallas, Texas.

According to an arrest report filed in Dallas, Gerry Lawson was taken into custody on June 26, 2013.

Louisville Metro police were searching for Lawson in after Vernice Aniton, 64, was found dead after a fire in her Cypress Street home on March 3. Further investigation into the fire revealed Aniton died before the fire.

Lawson is currently being held in the Dallas County Jail.

Court lifts ban on Calif. gay marriages

The four plaintiffs in the U.S. Supreme Court case that overturned California's same-sex marriage ban tied the knot Friday, just hours after a federal appeals court freed gay couples to obtain marriage licenses in the state for the first time in 4 1/2 years.

State Attorney General Kamala Harris presided at the San Francisco City Hall wedding of Kris Perry and Sandy Stier as hundreds of supporters looked on and cheered. The couple sued to overturn the state's voter-approved gay marriage ban along with Jeff Katami and Paul Zarrillo, who married at Los Angeles City Hall 90 minutes later with Mayor Antonio Villaraigosa presiding.

"By joining the case against Proposition 8, they represented thousands of couples like themselves in their fight for marriage equality," Harris, who had asked the appeals court to act swiftly, said during Stier and Perry's brief ceremony. "Through the ups and downs, the struggles and the triumphs, they came out victorious."

Harris declared Perry, 48, and Stier, 50, "spouses for life," but during their vows, the Berkeley couple took each other as "lawfully wedded wife." One of their twin sons served as ring-bearer.

Although the couples fought for the right to wed for years, their weddings came together in a flurry when a three-judge panel of the 9th U.S. Circuit Court of Appeals issued a brief order Friday afternoon dissolving, "effective immediately," a stay it had imposed on gay marriages while the lawsuit challenging the ban advanced through the courts.

Sponsors of California's same-sex marriage ban, known as Proposition 8, called the appeals court's swift action "outrageous." Under Supreme Court rules, the losing side in a legal dispute has 25 days to ask the high court to rehear the case, and Proposition 8's backers had not yet announced whether they would do so.

"The resumption of same-sex marriage this day has been obtained by illegitimate means. If our opponents rejoice in achieving their goal in a dishonorable fashion, they should be ashamed," said Andy Pugno, general counsel for a coalition of religious conservative groups that sponsored the 2008 ballot measure.

"It remains to be seen whether the fight can go on, but either way, it is a disgraceful day for California," Pugno said.

The Supreme Court ruled 5-4 Wednesday that Proposition 8's sponsors lacked authority to challenge the ban after Harris and Gov. Jerry Brown, both Democrats, refused to defend the ban in court.

The decision lets stand a trial judge's declaration that the ban violates the civil rights of gay Californians and cannot be enforced.

The Supreme Court said earlier this week that it would not finalize its ruling in the Proposition 8 case until after the 25-day period, which ends July 21. But San Francisco City Attorney Dennis Herrera, who joined the two couples in the lawsuit, said Friday that the 9th Circuit panel had the power to lift the stay it imposed.

"The fact of the matter is the only thing holding up the weddings was the stay that the 9th Circuit had in place," Herrera said. "The fact that there is a separate 25-day period allowing the petition to go for a rehearing is separate and apart from that stay."

Brown directed California counties to start performing same-sex marriages immediately after the appeals court's order. A memo from the Department of Public Health said "same-sex marriage is again legal in California" and ordered county clerks to resume issuing marriage licenses to gay couples.

Given that word did not come down from the appeals court until mid-afternoon, most counties were not prepared to stay open late to accommodate potential crowds. The clerks in a few counties announced that they would stay open a few hours later Friday.

A jubilant San Francisco Mayor Ed Lee announced that same-sex couples would be able to marry all weekend in his city, which is hosting its annual gay pride celebration.

Starbucks reports UK loss, pays no tax for 2012

LONDON (Reuters) - Starbucks, whose thin tax payments in Britain provoked a backlash against corporate tax avoidance when revealed by Reuters, paid no tax for the year to September 30, 2012.

The coffee giant's main UK subsidiary reported its 15th straight annual loss at its UK stores in accounts filed on Friday.

Reuters revealed in October that Starbucks reported consistent UK losses while telling investors the British unit was profitable and promoting managers of the unit within the group.

Friday's accounts showed a UK loss of 30 million pounds ($46 million), down from the 32 million pounds loss it reported for the previous year, helped by a 4 percent rise in turnover to 413 million pounds.

The company cited challenging economic conditions and a competitive UK coffee market, although the accounts show profits were also undermined by a royalty for the use of the Starbucks brand of 26 million pounds.

This is paid to an affiliate in the Netherlands, where Starbucks has negotiated what it said was a very low tax rate.

The UK unit also paid 2 million pounds in interest to affiliated companies, the accounts showed.

Following widespread criticism from politicians and the picketing of stores, Starbucks said it would pay or pre-pay around 10 million pounds a year in taxes in 2013 and 2014.

The company said it would not take tax deductions for certain intercompany payments such as the royalty fee, interest payments and the 25 percent mark up on coffee beans that is paid to a Swiss-based Starbucks coffee purchasing unit.

Starbucks recently paid 5 million pounds to the UK tax authority as the first installment of its 2013 tax bill, British media reported earlier this month.

Starbucks declined immediate comment.

Stocks face more hurdles after Fed statement

NEW YORK - Bargain-hunters beware! Wall Street's 2 percent weekly fall may not be the buying opportunity for stocks that it might seem.

The stock market begins the last week of June still rattled by the U.S. Federal Reserve's plans for reducing its stimulus efforts, called quantitative easing, or QE.

Next week could bring more big intraday swings and volatility as asset managers reevaluate their portfolios to adjust to the new regime of diminishing support from the Fed.

The CBOE Volatility Index, Wall Street's "fear gauge," rose 10.2 percent this week, ending Friday at 19. The index has risen in four of the past five weeks since Fed Chairman Ben Bernanke first broached the phasing out of stimulus.

"The angst over the Fed is going to cause people to reprice. Hedge funds are part that group. But I don't believe they are the only ones selling," said Ken Polcari, director of the NYSE floor division at O'Neil Securities in New York.

"Hedge funds are nimble, so they are the ones that can move the money around. With the VIX at 20, people get fearful, they want their cash."

Polcari said large asset managers also were likely to be moving around money.

Warning signs

With the Fed putting the market on notice that it will be weaned from easy money, possibly beginning before long, investors are going to look at the broad picture, which has plenty of warning signs. Economic growth remains spotty, Chinese credit markets are showing stress and interest rates are on the rise.

One reason for equity investors to worry is the second-quarter earnings outlook. Earnings warnings from companies for the second quarter outnumber positive outlooks by 6.5 to 1, the most negative ratio since the first quarter of 2001, according to Thomson Reuters data.

Investors say the impact of Washington's automatic federal spending cuts, known as sequester, is part of the cause.

The sequester has already had an impact on technology companies, and higher tax rates that took effect earlier this year, have hurt consumer businesses.

Among the sectors with the worst outlooks for the second quarter, consumer discretionaries top the list, with 21 warnings and just two positive outlooks. Technology was another, with 27 warnings and 6 positive outlooks, Thomson Reuters data showed.

"This quarter will have the most negative impact from the sequester," said Natalie Trunow, chief investment officer of equities at Calvert Investment Management, which has about $13 billion in assets.

"Combined with the tapering of QE, it could further dampen market sentiment, so we could be in for a little further softness in the equity market for a couple of months."

Among the 10 companies that have already reported for the quarter, a few have been cause for concern. Oracle posted disappointing software sales and blamed weaker-than-expected sales in Asia and Latin America. Its shares were down 8.8 percent at $30.30 on Friday.

Federal Express, while it posted a stronger-than-expected quarterly profit, cut jobs and said it was retiring some older, less efficient airplanes.

Falling earnings

Forecasts for S&P 500 earnings in the second quarter have declined sharply, from an April 1 forecast of 6.1 percent growth to this week's forecast of 3.2 percent growth.

If second-quarter earnings come in as forecast, they would mark a drop from the first quarter's 5.4 percent increase in earnings. However, estimates tend to start out high, then get cut as the earnings period nears. Then, typically, companies surpass the lowered forecasts.

"We've had that for several quarters and we could be looking at some of that again," Trunow said.

Banks, which are sensitive to interest rate changes, will be among the earliest companies to report. U.S. Treasuries yields rose to the highest in 22 months as a result of worries about the Fed's cutting back its monthly purchases of bonds. While the reduced stimulus could help if it boosts net interest margins, there are concerns that trading losses could hit some of the biggest banks.

Earnings projections for the rest of the year are better, with third-quarter growth forecast to rise 8.7 percent and fourth-quarter 13.1 percent, according to Thomson Reuters data.

If the Fed's expectations are correct and the economic data show strength, they will serve as a tailwind for stocks.

"Remember that (Fed) tapering would be a vote of confidence in the market, which would be good news," said David Joy, who helps oversee $708 billion in assets as chief market strategist at Ameriprise Financial in Boston.

Despite the week's 2.1 percent loss, the S&P 500 has risen 11.7 percent for the year without a major correction.

Commentary: I Can See Both Sides of Obama's Environmental Plans

Yahoo News asked voters to comment on President Barack Obama's climate change plan, which he largely unveiled in a speech on Tuesday. Here's one response.

COMMENTARY l In response to President Obama's environmental proposals to combat global warming, I am in a unique position in that I can directly see both sides of the debate. I live in a small town in West Virginia, "coal mine country," and home to two coal-fired AEP power plants, with another right across the Ohio River in view. The coal mines, the former top industry in West Virginia, have been closed already, which has resulted in thousands of jobs lost for families in this state. And while a lot of the union and power plant workers have found steady work during plant outages and keeping up with the EPA's new regulations on the scrubbers and more, thousands of workers face the inevitability of losing work around here permanently. One of the two power plants was just recently shut down.

I also know the effects of global warming on this planet. My geology professor was right when he declared that the devastation from global warming is imminent and inevitable. Obama is right that we need to act now. The president is on the right track with creating renewable energy sources in this country, and the only way to attempt to mend the damage caused by global warming, prevent future devastation (and catastrophe), and create jobs, thereby elevating our economy, is to see these proposals through.

Americans, along with the rest of the world, are going to have to evolve and move on to new and safer industries.

Exclusive: Samsung in talks to settle EU antitrust case -sources

BRUSSELS (Reuters) - Samsung Electronics is in early talks with the EU regulator to settle charges that its use of injunctions against arch rival Apple breached antitrust rules, two people familiar with the matter said on Tuesday.

Samsung and Apple, the world's top two smartphone makers by volume and sales, are embroiled in patent disputes in at least 10 countries as they vie to dominate the lucrative and fast-growing mobile market and win customers with their latest gadgets.

The talks came after the European Commission, which acts as EU competition regulator, told Samsung in December that it was acting unfairly by seeking court injunctions against Apple over the use of its patents.

"Samsung has been involved in settlement discussions for several months now. Samsung wants to settle," said one of the sources, who declined to be identified because of the sensitivity of the matter.

The sources said it was still too early to say if the discussions would result in a settlement. That would mean no finding of wrongdoing for Samsung and no fine, which could otherwise reach as much as $17.3 billion if the South Korean firm is found to be in breach of EU laws.

Both the European Commission and Samsung declined to comment.

Samsung came under EU regulatory fire last year when it began seeking injunctions in various EU countries in 2011 against Apple's use of its patents for the 3G UMTS standard despite pledging to license them on fair terms to rivals.

Asked why Samsung was seeking to settle instead of fighting the charges, Mario Mariniello, an analyst at think-tank Bruegel and a former Commission economist, said it was possible the company thought the regulator had built up a strong enough case against it.

"The Commission could construct a theory of harm based on the concept of a willing licensee, in which Apple was willing to pay but Samsung didn't negotiate," he said. "This would make it possible for it to sanction (punish) something that is contrary to competition law."

Latest leak suggest Nokia EOS PureView to pack 41MP camera, possible variant also spotted

We gotta say, originally we weren't very confident in the above alleged spy shots of the rumored Nokia EOS smartphone, but after talking to the leakster from Sina Weibo, we think we got this figured out. First of all, there are two parts here: the paint-less camera cover plate that now says "41 megapixel" -- the same camera resolution featured on the 808 PureView -- instead of "XX megapixel," and a metallic chassis of the EOS phone. But the latter (pictured center and right) looks slightly different to the other leaks we've come across so far: the bump is significantly smaller, and the holes inside don't match the ones on the cover plate. If you look even closer, the pin hole for what seems to be a SIM slot at the top is now on the other side of the slot.

Judging by his background and track record so far (he claims he also leaked the red EOS factory photos), we have reason to believe that this leakster does have a good source on the factory floor. Hence our two assumptions: either this chassis is an early engineering sample, or that this is a metallic variant of the plastic EOS. You know, like what the Lumia 925 is to the Lumia 920. We've been promised a few more photos in the coming days, and hopefully they'll unravel more mystery before Nokia lets the cat out of the bag next month.
